Gift Funds and Down Payment Assistance in Florida — Can You Use Both?

By Barrett Henry, REALTOR® & Broker Associate at REMAX Collective

Florida homebuyer reviewing gift letter and down payment assistance paperwork at closing

One of the most common questions Tampa Bay homebuyers ask is whether they can use a monetary gift from family and get down payment assistance at the same time. The short answer is yes — in most cases, gift funds and Florida DPA programs can be used together. But the details matter, and getting them wrong can delay or even derail your closing.

This guide explains how gift funds work alongside Florida's major down payment assistance programs, what documentation both require, and how to structure everything so your lender can approve it cleanly.

What Are Gift Funds, and Who Can Give Them?

A gift fund is money given to a homebuyer by a third party with no expectation of repayment. On FHA loans — the most common loan type paired with Florida DPA — gift funds can come from a family member (parent, sibling, grandparent, aunt, uncle, or cousin), a close friend with a documented relationship, an employer, a labor union, or a charitable organization approved by HUD.

What gift funds cannot be: a disguised loan. If there is any agreement — written, verbal, or implied — that you will pay the money back, it is not a gift and your lender cannot treat it that way. The IRS gift tax annual exclusion for 2026 is $18,000 per donor, per recipient. Gifts above that threshold may require the donor to file a gift tax return, though no tax is typically owed unless lifetime exemptions are exceeded. Your lender does not handle the tax side, but the donor should be aware of it.

Can You Use Gift Funds WITH Florida Down Payment Assistance?

Yes. Florida's major DPA programs — including Florida Hometown Heroes, FL Assist, and the HFA Preferred PLUS programs — are second mortgages or grants layered on top of a qualifying first mortgage. They do not prohibit you from also receiving a gift.

In practice, the combination works like this: your DPA second mortgage or grant covers a portion of your down payment and/or closing costs, and any remaining gap — or additional cushion you want to have — can come from a gift. For example, if you are buying a $320,000 home with an FHA loan at 3.5% down ($11,200), your Hometown Heroes assistance might cover $10,000, and a $1,200 gift from a parent could cover the rest. You close with zero out of pocket on the down payment itself.

What Documentation Does Your Lender Need for Each?

Both gift funds and DPA programs come with documentation requirements. Getting these right early prevents last-minute scrambles at closing.

For the gift:

  • Gift letter — signed by the donor, stating the amount, the property address, the relationship to the buyer, and an explicit statement that no repayment is required. Your lender will provide a template.
  • Paper trail — the lender must document where the money came from (a bank statement showing the donor had the funds) and that it moved into your account (a deposit on your own bank statement). Some lenders also require a bank statement from the donor to show the funds were sourced, not borrowed.
  • No recent large deposits without explanation — if a gift lands in your account the week before closing without a paper trail, underwriters will ask questions. Transfer the funds early and keep documentation of the transfer.

For your DPA program:

  • Income documentation (pay stubs, W-2s, tax returns depending on the program)
  • Completed homebuyer education certificate from a HUD-approved provider
  • DPA reservation letter from your lender confirming the program funds are held
  • Signed second mortgage note or grant agreement at closing

Do Any Florida DPA Programs Require You to Use Your Own Money?

Some programs do require a minimum borrower contribution from the buyer's own funds — not gifts, not DPA. This is called a "minimum borrower contribution" or MBC. However, FL Assist, Hometown Heroes, and HFA Preferred PLUS do not impose a minimum borrower contribution beyond what FHA already requires (3.5% of the purchase price — which can itself be covered by the gift and/or DPA).

Where this gets tricky is with conventional loans. FHA allows the entire down payment to come from a gift or DPA. Conventional loans through Fannie Mae and Freddie Mac have more restrictive rules: if your loan-to-value is above 80% (i.e., you are putting less than 20% down), you typically need at least 3% to 5% from your own funds, and the remainder can come from a gift. However, the HFA Preferred and HFA Advantage conventional loan products offered through Florida Housing Finance Corporation have their own overlays that often loosen these requirements — confirm with your lender.

What Happens If a Seller Offers a "Gift" Instead of a Concession?

Be careful here. Seller-funded gifts — arrangements where the seller effectively funds the buyer's down payment through a third party — were banned under the Housing and Economic Recovery Act of 2008 and are not allowed on FHA loans. If a builder or seller is offering to "contribute to your down payment," the proper vehicle is a seller concession toward closing costs, not a gift. Your lender will flag any arrangement that looks like seller-funded DPA.

How Gift Funds Affect Your Debt-to-Income Ratio

Gift funds themselves do not affect your debt-to-income (DTI) ratio because they are not income and they do not create a repayment obligation. Your DPA second mortgage is different: depending on the program, it may or may not require a monthly payment.

FL Assist is a deferred second mortgage at 0% interest with no monthly payment — it does not affect your DTI. The FL HLP second mortgage at 3% over 15 years does carry a monthly payment, which does count against your DTI. Hometown Heroes is a deferred second with no monthly payment. If stacking programs, the combination of your first mortgage payment plus any second mortgage payments must still fit within the program's DTI limits, typically 45% to 50% for FHA. A Real Example: Gift + DPA in Tampa Bay

Let's say a first-time buyer in Hillsborough County qualifies for Hometown Heroes and is buying a home at $310,000:

  • FHA loan at 3.5% down = $10,850 needed for down payment
  • Hometown Heroes covers 5% of the first mortgage ≈ $14,500 (more than covers the down payment)
  • A $5,000 gift from a parent covers a portion of closing costs
  • Seller concession covers remaining closing costs

Result: the buyer closes on a $310,000 home with minimal out-of-pocket expense. The DPA and gift together eliminate the largest financial barrier most Tampa Bay renters face.

Common Mistakes to Avoid

These errors trip up buyers who try to combine gift funds and DPA without proper guidance:

  • Moving money too late — getting a gift deposited the week before closing creates underwriting delays. Transfer funds at least 30 days before closing or be prepared with a full paper trail.
  • Using a personal check with no documentation — Venmo, Zelle, or cash deposits without a paper trail will trigger a large-deposit explanation letter and possible denial if the source cannot be verified.
  • Expecting the gift to cover reserves — most lenders and DPA programs require you to have 1 to 2 months of mortgage payments in reserve after closing. Gifts can be used for reserves, but they still need to be sourced and seasoned.
  • Not disclosing both sources upfront — your lender needs to know about every source of funds from the beginning. Disclosing a gift mid-process after your file is in underwriting can restart the approval clock.

Working with a REALTOR® who regularly handles DPA transactions is one of the best ways to avoid these pitfalls. Bottom Line: Gift Funds + DPA Is a Powerful Combination

Combining gift funds with a Florida DPA program like Hometown Heroes or FL Assist can genuinely get you into a home with little to nothing out of pocket. The key is working with a lender experienced in both FHA gift rules and Florida Housing programs, documenting everything early, and not trying to shortcut the paper trail. Done right, this strategy is one of the most effective ways Tampa Bay first-time buyers are closing on homes in 2026.
