Collections, Charge-Offs, and Down Payment Assistance in Florida — Can You Still Qualify?

One of the most common questions from Tampa Bay buyers exploring down payment assistance is whether past credit problems — unpaid collections, charged-off accounts, or lingering medical debt — put DPA out of reach. The answer is more nuanced than a flat yes or no. Florida DPA programs layer on top of a first mortgage, and it is the first mortgage's rules — primarily FHA or conventional — that govern how collections and charge-offs are evaluated. Understanding those rules gives you a realistic picture of where you stand before you ever sit down with a lender.
What Is the Difference Between a Collection, a Charge-Off, and a Judgment?
These three terms describe different stages of delinquent debt, and mortgage underwriters treat them differently:
- Collection account: An original creditor sold or transferred your unpaid debt to a collection agency. The agency reports the balance on your credit report. Collections stay on your report for up to seven years from the original delinquency date.
- Charge-off: The original creditor wrote off the debt as a loss after roughly 180 days of non-payment. The debt does not disappear — it is often sold to a collection agency or remains on your report as a charged-off balance. A charge-off is a derogatory mark that depresses your score.
- Judgment: A creditor won a court case against you for the unpaid debt. Judgments appear on public records, can lead to wage garnishment, and lenders almost universally require them to be paid in full or placed on a documented payment plan before closing can proceed.
The distinction matters because FHA and conventional guidelines treat each category differently — and that determines your path to DPA eligibility.
How Does FHA Handle Collections When You Apply for Down Payment Assistance?
Most Florida DPA programs that pair with FHA loans — including FL Assist, Hometown Heroes, and county SHIP programs — set a credit score floor on top of FHA's base minimums. While FHA technically allows borrowers down to a 500 score, virtually every Florida DPA program requires a minimum 640.
On collections specifically, FHA guidelines require lenders to evaluate accounts as follows: if the total outstanding balance of non-medical collection accounts exceeds $2,000, the lender must either document that the collection is being addressed or include 5% of the unpaid balance as a hypothetical monthly payment in your debt-to-income ratio (DTI) calculation. That phantom payment can push you over the 45–50% DTI ceiling that DPA lenders enforce, which is why the aggregate amount of your collections matters, not just whether they exist.
Medical collections are treated more favorably. FHA guidelines explicitly exclude medical collection accounts from the 5% DTI calculation, and recent regulatory changes have reduced how medical debt affects credit scores generally. Buyers whose derogatory accounts consist primarily of medical debt are often in a stronger position than they expect when they pull their full credit report.
What FHA generally does not require is that collections be paid off before closing — unless they have become judgments, or unless the lender's own overlay policy requires payoff. Lender overlay policies vary significantly among DPA-approved lenders, which means shopping among at least two or three lenders can produce meaningfully different results for the same credit file.
Does a Charge-Off Disqualify You From Florida Down Payment Assistance?
A charge-off does not automatically disqualify you. A paid charge-off — where the balance has been settled or paid in full — still appears as derogatory on your report but creates fewer underwriting obstacles than an unpaid one. Lenders want to see that debts were eventually resolved.
For unpaid charge-offs, the analysis depends on the amount, the age of the account, and whether the account has been transferred to a collection agency. If it appears as both a charge-off and an active collection account, most lenders apply the FHA collection rules described above. If the charge-off remains with the original creditor and has not moved into collections, individual lender policies apply — and again, this is a place where lender selection makes a real difference.
The credit score impact of a charge-off is typically already baked into your current score. If you have a 640 or higher score despite a charge-off on your report, the underwriting treatment may be manageable with the right lender. How Do Conventional DPA Programs Treat Collections Differently?
Conventional DPA programs — primarily HFA Preferred and HFA Advantage — follow Fannie Mae and Freddie Mac guidelines rather than FHA rules. Fannie Mae guidelines do not impose the same 5% DTI calculation for unpaid non-medical collections that FHA requires. For some buyers, a conventional loan may actually accommodate collections more cleanly in the DTI math — but the 640 credit score minimum remains, and collections tend to drag scores down.
The practical result: a buyer with a 650 score and $4,000 in non-medical collections might qualify more easily for a conventional DPA program than an FHA DPA program, because the conventional underwriting skips the DTI penalty that FHA imposes. Working through this comparison with a DPA-approved lender before assuming which loan type fits your file is essential — it is not always obvious which path is better without running the numbers.
What Happens to Your DPA Application If You Have a Judgment?
Judgments are the most disruptive derogatory item for DPA applicants. Lenders require a judgment to be either paid in full or on a court-approved payment plan with at least three consecutive on-time payments before approving a mortgage. A judgment will surface during the title search regardless of whether it shows on your credit report — there is no hiding it — and it must be resolved before closing can proceed.
Tax liens work similarly. A federal tax lien requires an IRS-approved installment agreement, and most lenders require three consecutive on-time payments under that agreement before approving the loan. If you have an unresolved judgment or tax lien, work with an attorney or directly with the creditor to establish a payment structure before applying for DPA.
Which DPA Programs Are Most Accessible for Tampa Bay Buyers With Credit Challenges?
For buyers below 640 who are working toward DPA eligibility, the NACA mortgage program is the one zero-down path worth understanding. NACA has no minimum credit score — their counselors evaluate payment history and financial behavior rather than a score threshold. The tradeoff is a three-to-six-month counseling and qualification process and a single lender (Bank of America) with no ability to stack additional DPA programs on top.
For buyers who can reach 640, the FL Assist and FHA combination remains the most accessible DPA path in Florida. What Should You Do Right Now If You Have Collections and Want DPA?
Start with a full tri-merge credit report — the same one a mortgage lender will pull. Identify each derogatory account as medical or non-medical, paid or unpaid, collection or charge-off or judgment. Tally the aggregate unpaid balance of non-medical collections to determine whether you clear or exceed the $2,000 FHA threshold. Then map your score against the 640 floor required by virtually all Florida DPA programs.
From there, apply with at least two DPA-approved lenders. Overlay policies vary significantly — one lender may approve the same file another declines based on internal standards stricter than FHA minimums. A side-by-side comparison at this stage costs nothing and can save significant time.
